Terms of Service

      Please read these terms carefully before using KindL. By downloading or using the app, you agree to be bound by these Terms of Service.
    

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the KindL mobile application ("App"), operated by KindL ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old to use KindL. By using the App, you represent and warrant that you meet this age requirement.

3. Your Account

To use KindL, you must create an account. You agree to:

Provide accurate and complete registration information
Keep your password secure and confidential
Notify us immediately of any unauthorized access to your account
Be responsible for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

KindL offers both free and premium subscription tiers.

Free Tier: Provides access to a limited set of features at no cost.

KindL Premium: A paid subscription that unlocks the full feature set. Subscription details including pricing are displayed within the App before purchase.

Billing: Subscriptions are billed through Apple's App Store. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.

Cancellation: You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until that date.

Refunds: All purchases are processed by Apple. Refund requests must be submitted directly to Apple in accordance with their refund policy.

Price Changes: We reserve the right to change subscription prices. We will provide reasonable notice of any price changes before they take effect.

5. User Content

KindL allows you to upload photos, write journal entries, and create other content ("User Content"). You retain ownership of your User Content. By uploading content, you grant KindL a limited, non-exclusive license to store, display, and transmit your content solely as necessary to provide the service to you and your partner.

You agree not to upload content that:

Is illegal, harmful, threatening, abusive, or harassing
Infringes any third party's intellectual property rights
Contains nudity, explicit sexual content, or graphic violence
Violates anyone's privacy or right of publicity
Contains malware, viruses, or other harmful code

We reserve the right to remove content that violates these Terms.

6. Partner Connections

KindL is designed for use by couples. When you connect with a partner:

Certain content and activity is shared between your accounts
Either partner may disconnect the relationship within the app at any time
Upon disconnection, shared content (such as scrapbook photos) will no longer be accessible to the disconnected partner

You are solely responsible for the partner you invite and connect with on KindL.

7. AI Features

The Scrapbook AI Editor uses artificial intelligence to help you customize your scrapbook. By using this feature:

You acknowledge that AI responses are generated automatically and may not always be accurate
You agree not to use the AI feature to generate inappropriate, harmful, or illegal content
We are not liable for any AI-generated suggestions you choose to apply

8. Prohibited Uses

You agree not to:

Use the App for any unlawful purpose
Attempt to gain unauthorized access to our systems or other users' accounts
Reverse engineer, decompile, or disassemble the App
Use automated bots or scrapers to access the App
Impersonate any person or entity
Use the App to harass, stalk, or harm another person
Interfere with or disrupt the integrity or performance of the App

9. Intellectual Property

The KindL app, including its design, graphics, features, and content (excluding User Content), is owned by KindL and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on any part of the App without our prior written consent.

10. Disclaimers

KindL is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

KindL is not a licensed mental health service, therapy platform, or relationship counseling service. The app is intended to be a fun and engaging tool for couples and should not be used as a substitute for professional relationship counseling.

11. Limitation of Liability

To the fullest extent permitted by applicable law, KindL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless KindL and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. You may delete your account at any time within the App settings. Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including but not limited to Sections 9–14) will survive.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in California.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice within the App or sending an email to your registered address. Your continued use of the App after changes become effective constitutes your acceptance of the updated Terms.
